AquaBoss License Agreement

This is a legal agreement between you and Curve2 Design covering your use of AquaBoss. Please read this software license agreement carefully before purchasing AquaBoss. By purchasing AquaBoss you are consenting to be bound by this agreement. If you do not agree to all of the terms of this agreement, do not purchase AquaBoss.

AquaBoss is owned by Curve2 Design and is protected by United States copyright laws and international treaty provisions. Therefore, you must treat AquaBoss like any other copyrighted material (e.g., a book or musical recording). Paying the license fee allows you the right to use one (1) installation of AquaBoss on one (1) web site.

Except as otherwise expressly permitted in this Agreement, you may not: reproduce or copy any of AquaBoss; modify or create any derivative works of AquaBoss, including translation or localization; decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for AquaBoss; redistribute, encumber, sell, rent, lease, or sublicense AquaBoss; remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in AquaBoss; or copy the printed materials accompanying AquaBoss. Any changes to, modifications to, plugins for, or derivative works of AquaBoss shall become the exclusive property of Curve2 Design.

If you violate any part of this agreement your right to use AquaBoss terminates automatically and you must discontinue use of and destroy any and all copies and/or derivative works of AquaBoss in your possession.

You may make one (1) archival copy of AquaBoss provided you affix to such copy all copyright, confidentiality, and proprietary notices that appear on the original.

If a refund is issued to the purchaser for the purchase of AquaBoss the purchaser's right to use AquaBoss terminates automatically and all copies of the AquaBoss script including any archival copies must be destroyed. Failure to destroy all copies of the AquaBoss script when a refund is issued will constitute as software piracy and the violator will be prosecuted to the fullest extent of the law.

You may transfer all your rights to use AquaBoss and Documentation to another person or legal entity provided you transfer this Agreement, AquaBoss and Documentation, including all copies, updates and prior versions to such person or entity and that you retain no copies, including copies stored on computer. Your rights to use the AquaBoss script may not be transferred if a refund has been issued on your purchase of the AquaBoss script.

AquaBoss and its related documentation are provided "AS IS" and without warranty of any kind and Curve2 Design expressly disclaims all other warranties, expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Under no circumstances shall Curve2 Design be liable for any incidental, special, or consequential damages that result from the use or inability to use AquaBoss or related documentation, even if Curve2 Design has been advised of the possibility of such damages. In no event shall Curve2 Design's liability exceed the license fee paid, if any.

Each license of the AquaBoss script will automatically register itself with Curve2 Design upon installation. This is a measure taken by Curve2 Design to prevent software piracy.

Curve2 Design reserves the right to verify your purchase of AquaBoss at any time by requesting the purchaser's name, email address used for placing the order and the order number. Failure to provide the information requested will constitute as a violation of this license agreement.

This Agreement shall be governed by the laws of the State of Pennsylvania. If for any reason a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision of the Agreement shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.
